COMMISSION DECISION
CONCERNING THE APPLICATION OF THE ARTICLE 47 OF THE FINANCIAL REGULATION TO THE ESTABLISHMENT PLAN OF THE JOINT RESEARCH CENTRE IN 2006
1. BACKGROUND
Article 47 of the Financial Regulation (EC, Euratom) n° 1605/2002 of 25 June 2002 applicable to the general budget of the European Communities allows institutions to modify their establishment plans under certain conditions and limits provided that the Budgetary authority is informed three weeks in advance of the intentions of the institution and that no duly justified reasons are raised within this period.
The Commission should apply the same promotion criteria to the whole staff concerned by the different establishment plans. It is therefore necessary to adapt the Joint Research Centre (JRC) establishment plan to take into account the promotion thresholds planned by the Commission for the exercise 2006.
Therefore the Commission informs the Budget Authority of the application of the flexibility foreseen in the Article 47 of the financial regulation to the establishment plan of the JRC, so partially advancing the modifications requested by the Preliminary Draft Budget 2007.
This modification fulfils the conditions laid down in the article 47 of the Financial Regulation:
- Grades A1, A2, and A3 are not modified.
- Volume of staff appropriations corresponding to a full financial year are not affected.
- Total limit of posts authorised in the establishment plan is not exceeded.
- Posts modified are less than the 10% of the total posts authorised in this establishment plan.
This decision of the Commission will only enter into force three weeks after the notification of the intention of the Commission to the budgetary authority and is conditional to the successful outcome of the procedure. If the budgetary authority raises duly justified reasons, the Commission will refrain from applying this decision and the current establishment plan will remain in force.
The new establishment plan attached in the annex is compared to the establishment plan currently in force.
2. DECISION BY THE COMMISSION
THE COMMISSION APPROVES
- The present amendment of the Joint Research Centre's establishment plan for the year 2006 as detailed in the annex and in compliance with the article 47 of the Financial Regulation. This modification will only enter into force if no duly justified reasons are raised by the budgetary authority.
